Terms of Service

Welcome to Fatekissed. Please read these terms carefully: by creating an account or using the service, you agree to them.

1. Who we are

Fatekissed is the trade name of Airblocks, a sole proprietorship based in Weert, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 83569340. In these terms, "we", "us" or "Fatekissed" refers to this business, and "you" refers to the user of the service. You can reach us at [email protected].

2. The service

Fatekissed is an online service in which you experience interactive, fictional romance stories together with an AI narrator, where your choices decide who you trust and who you love. The service is under active development; parts of it may change, be temporarily unavailable, or be removed.

3. Your account and access

• You need an account to play. Access is sometimes granted through an invitation or access code.
• You are responsible for everything that happens under your account and for keeping your login details secret. Do not share your account, and report any misuse as soon as possible to [email protected].
• You provide accurate and complete information when registering.

4. Age

You must be at least 16 years old to create an account and use the service. If you are younger, you may use Fatekissed only with the permission and supervision of a parent or guardian, who accepts these terms on your behalf. Fatekissed tells mature romantic stories that can include confronting themes such as peril, conflict or dark fantasy (see section 7). Intimate moments are always "fade to black": the service is built and filtered not to generate sexually explicit content. Fatekissed is not intended for children.

5. Buying adventures and payments

• Individual adventures, no subscription. You buy complete adventures individually. A single one-time purchase gives you access to that adventure. There is no subscription and no credit balance to keep track of.
• Try for free. For a paid adventure you play the first chapter free. If you want to continue, you buy the adventure. The price is shown before purchase and includes VAT where applicable. Payments are handled by our payment provider (Mollie).
• What you get (fair use). A purchase gives you the right to play that adventure and to replay it once. Once you have played both and want to experience it again, you buy another run. This limit only protects against unlimited or automated use; in normal play you will not notice it. A purchase is personal and non-transferable.
• Right of withdrawal. An adventure is digital content that becomes available immediately. When you make a purchase, you expressly ask us for immediate delivery and you acknowledge that you thereby lose your statutory 14-day right of withdrawal as soon as delivery begins. You receive an order confirmation by email.
• Refunds. We do not refund an adventure whose access has already been delivered. If access is lost due to a fault on our side, we will look for a reasonable solution.
• We may change prices. This does not apply retroactively to adventures already purchased.

6. Acceptable use

You will not use Fatekissed to:

• break the law or harm others;
• generate or distribute content that is illegal, such as child sexual abuse material, incitement to violence or hatred, or the threatening or harassment of real persons;
• impersonate or harass real, identifiable individuals;
• abuse, overload, circumvent, reverse-engineer or automatically scrape the service, the AI narrator or its security;
• resell or commercially exploit the service without our written permission.

We may remove or block content or behaviour that breaches these rules, and may suspend or terminate access.

7. AI content: fiction, not advice, unpredictable

This section is important. Please read it carefully.

• Everything is fiction. The stories, characters, places and events the AI narrator produces are invented. Any resemblance to real persons, organisations or events is coincidental.
• Open-ended, within limits. The AI narrator responds to almost any input and can generate a wide range of fictional content, and its tone, accuracy and quality are produced automatically, are not reviewed by a human beforehand, and cannot be fully predicted. Stories can include confronting themes such as peril, conflict, horror or suspense. Sexual content is the firm exception: intimate scenes always stay "fade to black", and the service is built and filtered not to generate sexually explicit content, whatever you enter.
• Not our views. AI output does not reflect any opinion, advice or position of Fatekissed or of anyone else.
• Not advice. The content is intended for entertainment only. It is not medical, legal, psychological, financial or any other professional advice, and you should not rely on it or act on it. If you need help, please consult a qualified professional.
• Your input, your responsibility. You are responsible for what you enter. Do not enter sensitive personal data or confidential information (see also the Privacy Policy).
• You accept this. By using the service you understand and accept that you may encounter unexpected or confronting fictional content. We may use safety measures and filters, but we cannot guarantee that unwanted content will never appear. If you come across content that really should not appear, please report it to [email protected].

8. Content and intellectual property

• The service itself, including its software, design, pre-made campaigns and AI narrator personalities, is owned by Fatekissed or its licensors and is protected. You receive a personal, non-transferable right to use the service as intended.
• Your own input and the story history you build remain yours, to the extent any rights apply to them. You grant us a limited right to store and process that content in order to provide the service to you (see the Privacy Policy).
• Because of the nature of AI, generated output may carry limited or no copyright, and similar output may also be shown to others. You cannot claim exclusivity over generated content.

9. Availability

We do our best to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may maintain, change, limit or (partly) discontinue the service. Because the service is still under active development, features may change.

10. Liability

• The service is provided "as is" and "as available", without warranties, to the extent permitted by law.
• To the extent permitted by law, we are not liable for indirect or consequential damage, for loss of data or credits, or for damage arising from AI-generated content or from your use of the service.
• To the extent permitted by law, our total liability is limited to the amount you paid us in the three months before the event, or to 50 euros if that is higher.
• Nothing in these terms limits liability that cannot be excluded or limited by law. Your mandatory rights as a consumer remain fully in force.

11. Indemnification

You indemnify Fatekissed against third-party claims arising from your use of the service in breach of these terms or the law.

12. Termination

• You can have your account deleted by contacting us at [email protected].
• We may suspend or terminate your access if you breach these terms or the law, or in case of misuse.
• On termination, your right to use the service ends. If unused, paid credits are lost due to a termination on our side without valid reason, we will reimburse them proportionally.

13. Governing law and disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent Dutch court, unless mandatory law designates another court. As a consumer, you may also submit a dispute through the European ODR platform: https://ec.europa.eu/consumers/odr.

14. Changes to these terms

We may amend these terms. For important changes we will inform you in advance and, where necessary, ask for your agreement again. If you continue to use the service after a change, the updated terms apply.
